The Delhi High Court, while hearing a petition on Friday (May 2), has issued a notice to the Center and the Delhi government to make adequate arrangements for housing for judicial service officers.

The bench of Justice Manmohan and Justice Manmeet Pritam Singh Arora has sought response from the Government of India, the Ministry of Law and Justice, the Chief Secretary to the Government of Delhi and the Registrar General on the matter.

The next hearing of the case will be on 16 July.

Debate in the petition – Half of the officers do not have government housing
The Delhi Judicial Service Association, while filing the petition, told the court that the total number of judicial officers in Delhi at present is 823, but there are only 347 houses for judicial officers.

These figures show that the state of government accommodation for judicial officers in Delhi is very poor. This problem is old and now the time has come to fulfill this demand.

The petitioner said that the 14th report of the Law Commission in 1958 highlighted the shortage of government accommodation for judicial officers and the compulsion of officers to live in rented accommodation.

The petition further stated that even today the situation has not changed. Officers have to go through situations of stress and pressure to get a good house.

The allowance given for a house on rent is much less than the market rate.
Officers are paid 27% of basic salary for rented accommodation, which is much lower than the current market rate. The petitioner said that officers who live with their families have to worry more about the house. Many officers are forced to live in distant areas like Faridabad, Noida and Ghaziabad.

The petition also said that the number of residences issued for Central and State Service officers was much more than the number for judicial officers. In such a situation, until necessary accommodation is arranged, judicial officers should be allowed to live in the residences of the Central and State Services.
