SC seeks Haryana govt’s reply on plea to fir against police officials in 2013 custodial death case – Amar Ujella Hindi News Live Achi-News

The Supreme Court has agreed to hear a plea seeking registration of a criminal case against the policemen in whose custody a 32-year-old man died in Haryana’s Faridabad district. This topic is from 2013.

A bench of Justice Sudhanshu Dhulia and Justice PB Varale issued a notice to the Haryana government and the Director General of Police on the petition of Anand Rai Kaushik, brother of the deceased. The bench listed the case for further hearing on July 26.

Anand Kaushik, in his petition filed through advocate Rahul Gupta, challenged the order passed by the Punjab and Haryana High Court on November 28 last year. The Supreme Court rejected his request to register a criminal case and transfer the investigation to the Central Bureau of Investigations or any other investigating agency.

The petitioner claimed that his brother Satendra Kaushik died while in custody at the NIT police station in Faridabad on 25 July 2013. Anand Kaushik also claimed that his brother was taken into custody by the police without any FIR on the complaint of a hotel manager for non-payment of bills.

However, the police claimed that Satendra Kaushik committed suicide by hanging from the bathroom window of the police station. The Supreme Court said on November 28 last year that on March 11, 2015, a coordination bench passed the order after perusing the judicial inquiry report, all relevant daily diary reports of the police station and the post-mortem report prepared by the medical board. and hence it was clear that there was no collusion in this case.

The court said that there is no need to register an FIR to start an investigation. The High Court order also stated that the coordination bench took a lenient approach and ordered the payment of compensation since the death occurred in police custody.
