The right to sleep is a basic human requirement, which cannot be violated: Bombay HC Achi-News

The lawyer of the investigative agency, Hiten Vangaonkar, claimed to the court that Israni agreed to record his statement during the night.

According to the request, Israni was interrogated until 3 am by officials.

“Voluntarily or otherwise, we reject the manner in which the petitioner’s statement was recorded so late at night, which continued past midnight until 3:30 am,” the court said.

Lack of sleep affects a person’s health and may damage their mental abilities, cognitive skills and so on, it says.

“The said person, who has been summoned in this way, cannot be deprived of his basic human right, that is, his right to sleep, by the agency, beyond a reasonable time. Statements must necessarily be recorded during Earth hours and not at night when the person’s cognitive skills can be impaired,” the bench said.

The court noted that when a person is summoned for questioning, the investigating agency has not yet reached “reason to believe” that said person is guilty of the crime.
