The central government had to face the displeasure of the court when it approached the Supreme Court to challenge the decision of the Meghalaya High Court. A division bench of two judges in the court expressed displeasure with the central government’s attitude, saying that the decision to challenge the High Court order is an abuse of the legal process. In the court, the bench of Justice Vikram Nath and Justice Satish Chandra Sharma said that there is no basis to challenge the High Court order. Expressing displeasure, the court also ordered the central government to pay a fine of Rs 5 lakh. The angry court said, the petitioners are warned not to file such frivolous petitions in future.

The court said that we are not ready to interfere with the High Court’s decision. The Supreme Court said that the Special Leave Petition (SLP) was dismissed as the attorney of the petitioner (the central government) before the High Court claimed that the issue was completely covered by the court’s previous ruling. After that, the High Court decided the case based on the statement of the lawyer of the central government.

The case is related to the Central Administrative Court

The Supreme Court bench heard an appeal against the High Court order. The Supreme Court upheld the decision of the Central Administrative Tribunal (CAT). The High Court dismissed the case after considering the central government’s contention that a similar petition had been rejected earlier.

The Supreme Court bench said that we impose a fine of Rs 5 lakh on the petitioners. The amount of the fine will have to be deposited in the welfare fund for war victims of the security forces, Canara Bank within eight weeks. This amount will be deposited in the southern block of the Defense Headquarters branch. After depositing the said amount in the said fund, the petitioners will then submit proof of the deposit of the funds in the registry of this court within a week.
