‘The husband has no right over the wife’s wealth’; An important ruling by the Supreme Court in a case Achi-News

New Delhi: At the time when the Lok Sabha Elections are heating up, politicians are discussing many issues including the Mangalyasutra of women. Meanwhile, the Supreme Court has given an important verdict regarding the right of women.

The Supreme Court in its landmark judgment has clearly stated that a woman’s money is her entire property and that she has every right to spend it as she wishes. The court ruled that the husband could never become a partner or share this woman’s wealth, but in times of crisis in life, the husband could use it as the wife wished.

A bench of Justice Sanjeev Khanna and Justice Dipankar Dutta ordered the husband to pay a monetary compensation of Rs 25 lakh for using his powers under Article 142 of the Constitution to rob the wife of all her jewellery. Keeping in mind the increase in cost of living, in the interest of fairness and justice, compensation is ordered to be given to the aggrieved woman of the petitioner. The victim is now 50 years old.

On April 5, 2022, the Supreme Court overturned the judgment of the Kerala High Court where it quashed the order of the family court in 2011 to recover gold worth Rs 8 lakh 90 thousand from the husband at the time of divorce. The Supreme Court rejected the High Court’s contention that it was not credible that all the gold jewelery of a newly married woman had been taken away on the first night. Greed is a major reason, the bench said, that drives human beings to commit the most heinous crimes.

In fact, on the first night of their marriage in 2003, the woman claimed that her husband took all her jewelery to her mother-in-law for safekeeping. However, the High Court blamed lack of good will on the part of the woman for the petition filed in 2009, but the husband-wife relationship ended in 2006. In this regard, the Supreme Court has held that rarely that matrimonial affairs can be said to be simple or straightforward.
