The Union Ministry of Health says that it is the responsibility of the states to decide on the fees of each doctor or hospital. The ministry informed the Supreme Court in a 37-page affidavit that the amount of treatment should be determined based on regional factors. How much should a patient pay? It depends on the type of hospital, the city and the experience of the doctor. The ministry even said that setting any price ceiling could severely damage the quality of health services or patient care. Fixing treatment rates can lead to serious situations such as making hospitals financially unviable.

Quoting Madhya Pradesh and Gujarat, the ministry said this issue was discussed with the states in March, where both these states said that setting any tariff cap could harm quality. Uttar Pradesh and Uttarakhand also supported him. Whereas West Bengal said 95 percent of its population receives affordable healthcare. Therefore there is no need to set rates there.
