Supreme Court’s reserve order on EVM-VVPAT adjustment, says it has no control over the elections Achi-News

GUWAHATI: The Supreme Court of India on April 24 reserved its order on a plea for 100 percent harmonization of EVMs and Voter Verified Paper Audit Trails (VVPATs) while also asserting that it has no control over the elections, which are being conducted by the Election Commission of India, itself constitutional body.

The bench of Justices Sanjiv Khanna and Dipankar Dutta had earlier said that it needed clarification on certain aspects as there was some confusion in the answers given by the ECI in its ‘Frequently Asked Questions’ (FAQs) on EVM issues.

During the hearing, Datta pointed out to advocate Prashant Bhushan that there have been no reported cases of malware being loaded with the symbol." Data asked.

“To date, there has been no report of such an incident (malware that is loaded together with the symbol). We cannot control the elections Mr. Bushan, we cannot control another constitutional authority," Judge Data commented.

Judge Khanna calmed down, "If there is room for improvement, we can certainly improve it. The courts intervened twice: first, when we mandated use of VVPAT, and second, when we increased verification from one to five percent." The Supreme Court also emphasized that whenever suggestions were made to improve the voting process, the submissions consistently advocated returning to the ballot box.
