NEW DELHI: The Supreme Court has issued a notice to the Election Commission in relation to a public interest petition filed on what to do if the nota votes are more than the votes obtained by the candidate who’ n fight the election. The PIL demanded that candidates who got less than NOTA should not be allowed to contest in the by-election to the same constituency.
A bench of Supreme Court Chief Justice (CJI) DY Chandrachud and Justices JB Pardiwala and Manoj Mishra allowed author Shiv Khera’s PIL. Candidates securing less than NOTA votes will be barred from contesting all elections for a period of 5 years. The PIL sought to frame rules that Nota should be promoted as a ‘false candidate’.
