Supreme Court on Stridhran: A husband has no right to a woman’s jewellery, the Supreme Court’s big ruling on stridhan Achi-News

The husband has no right in ‘stridhna’, it is the wife’s own property. The jewelery given to the wife as a gift after marriage is called ‘Stridhana’. The husband can use his wife’s jewelery for want or need, but only the wife has the right over it. So even if the jewelery is used at the time of need, it must be returned. Dipankar Dutta and the Sanjeev Khanna division bench of the Supreme Court gave such a verdict.

In the case of a Kerala couple, the Supreme Court ordered the husband to return Rs 25 lakh for his wife’s jewellery. The husband took the jewelery which the wife had received as a gift on the wedding night from the husband on the pretext of keeping it safe. The woman later found out that the jewelery was being used to pay off the family’s debt. Afterwards, the woman went to court hoping for justice.

The Supreme Court observed that only the woman has rights over ‘stridhaan’. Even if they are used unnecessarily, it is the husband’s moral responsibility to return them later. The country’s highest court said the amount of jewelery the woman’s husband took from her in 2009 was worth 8 lakh 90 thousand rupees. According to the current market price of gold, the husband has to return 25 lakh rupees.
