The Supreme Court said that an extrajudicial confession is not concrete evidence, but it can be presented as supporting evidence along with any concrete evidence. Having said this, the Supreme Court acquitted the culprit in the murder case that took place in 1998. The Supreme Court accepted the petition challenging the decision of the Punjab and Haryana High Court.

Confessed the crime to the deceased’s brother and another person

The Punjab and Haryana High Court upheld the trial court’s 1999 order, which convicted the man of murder and sentenced him to life imprisonment. The prosecution claimed that the appellant murdered a man in a movie theater in Bivani in June 1998. The accused suspected that he was having illicit relations with his (the accused’s) wife. A bench of judges B.R. Gabbay and Sandeep Mehta said that the prosecution’s case was based mainly on the statements of two witnesses, including the deceased’s brother and another person. He claimed that the accused confessed to the offense before him.

The Supreme Court found weak evidence for an extrajudicial confession

Referring to the evidence in the case, the public said that these two witnesses fall into the category of ‘completely unreliable witnesses’ and it would not be correct to rely on their words to confirm the guilt of the accused. Noting the alleged extrajudicial confession of one of the witnesses, the bench said the evidence of another prosecution witness contradicted it. The Supreme Court said, “An extrajudicial confession is inherently weak evidence. It can only be used as supporting evidence along with concrete evidence.
