The Bombay High Court, while dismissing a petition, said that if a woman cannot become a good wife, it does not mean that she cannot become a good mother. The court dismissed the petition of the former MLA’s son, transferred the custody of the nine-year-old girl to her mother and said that Adultery can be grounds for divorce but not for child custody. We will tell you, in the petition an appeal was filed against the order of the family court in which custody of his daughter was given to his wife.

In fact, the young man who submitted the petition was married in 2010. Their daughter was born in 2015. In 2019, the woman claimed that she was thrown out of her home. However, the petitioner says that his wife left of her own accord. The petitioner’s lawyer, Indira Jaising, told the court that the woman has many affairs, so it would not be right to give her the custody of the child. The petition claims that his daughter would be happy to live with him and his parents. He is not happy with his mother. The girl’s school authorities also wrote an email to the petitioner’s mother expressing concern over the woman’s behavior.

The court made this comment

A single bench of Justice Rajesh Patil, while hearing the case, objected as to why the school contacted the grandmother when the girl’s parents were studying on their own. The court said that there is no reason for the school authorities to tell the grandmother about the issues related to the child. The girl is only nine years old, and hence the court has to consider the best interests of the child first. According to him, the girl was taken care of by her maternal grandmother and under her mother’s guardianship, her educational record is also quite good. There is no reason to give custody of the child from the wife to the husband.
