New Delhi (August 18): The Supreme Court has allowed yoga guru Baba Ramdev and his associate Acharya Balakrishna to tender a public apology in the allopathy misleading and defamatory advertisement case. The Supreme Court gave both of them a week to apologize and explained that they are not going to give compensation at the moment.

During the proceedings, Baba Ramdev and Acharya Balakrishna were present in the court in person. This was his third solo show. Senior advocate Mukul Rohatgi, who appeared for the duo, told a bench of Justice Hima Kohli and Justice Ahsanuddin Amanullah that they apologized unconditionally and were ready to apologize publicly.

What claim did the IMA make?

In its petition, the Indian Medical Association alleged that Patanjali had violated two laws. The first is the Drugs and Magic Drugs Act 1954 and the second is the Consumer Protection Act 2019. The Drugs and Magic Drugs (Offensive Advertisement) Act, 1954 clearly states that unless scientifically proven, a specific disease has been completely proven. If a drug is healing, it is illegal to advertise and make misleading claims about it. Similarly, the Consumer Protection Act states that no company can mislead consumers. You cannot trap them by showing false and misleading ads. Any company that does this will be subject to legal action.

Matter of FIR to Court

During the Corona pandemic, when Baba Ramdev made controversial statements about allopathic medicines, he started a direct battle with the IMA. Later, state units of IMA filed FIRs against Baba Ramdev in different states. Baba Ramdev then went to the Supreme Court and said that the comments he made did not in any way fall within the ambit of the offence. There was a demand that all the FIRs should be consolidated and transferred to Delhi.

In 2021, when the Corona pandemic was at its peak, Baba Ramdev said that lakhs of people lost their lives due to allopathic medicines. During the hearing on April 16, Justice Kohli asked about the press conference that Baba Ramdev had addressed after the Supreme Court’s order on November 21 last year.

Accordingly, the lawyer representing Patanjali Ayurveda assured that “there will be no further violation of the law especially in relation to advertising or branding of products manufactured and sold by Patanjali Ayurveda”. During the hearing on April 16, the Supreme Court told Baba Ramdev ‘You cannot degrade allopathy. You are doing your job.’ The bench told him that there are several systems of medicine in India such as Ayurveda, Yoga, Allopathy and Unani and the public uses all of them. It is not right to call any system bad and ask for its abolition.
