NEW DELHI: A hearing was held in the Supreme Court seeking cross-verification of 100% Electronic Voting Machine (EVM) votes and Voter Verifiable Paper Audit Trail (VVPAT) slips. A bench of Justice Sanjeev Khanna and Justice Dipankar Dutta told the petitioners that not every aspect of the system can be questioned and not everything can be criticised. Judgment is reserved after hearing this petition.

Advocates Prashant Bhushan, Gopal Shankaranarayan and Sanjay Hegde appeared for the petitioners, Advocate Maninder Singh for the Election Commission and Solicitor General Tushar Mehta for the Central Government.

Advocate Prashant Bhushan mentioned before the court that the BJP was getting more votes during the fake polls held in Kerala. To this, a two-member bench comprising Justice Sanjeev Khanna and Dipankar Dutta questioned Election Commission lawyer Maninder Singh on the EVM issue. But Singh said these reports are false and baseless.

At the same time, he asked to give VVPAT slip to the voters after voting. The court asked the Electoral Commission about this. Commenting on this, the Election Commission said that there is a big risk in giving VVPAT slips to voters. It threatens the confidentiality of the vote and can be misused outside the voting booth. That said, we can’t say how others will use it.

What is the candidate?

Prashant Bhushan, counsel for the petitioner, suggested that the light on the VVPAT screen should be illuminated during voting. He said that the voters should know from this whether their vote has gone to the party they want. Advocate Nizam Pasha also suggested that the voters themselves should get the VV Pat slip after casting their vote for certainty.

At this time, the bench intervened and answered the question of lawyer Prashant Bhushan that he should not be suspicious about everything. “Now you’re going too far. Everything cannot be doubted. You cannot criticize everything, would you please appreciate them (Election Commission) if they have done something good, said Justice Khanna.

The court asked the Electoral Commission counsel to submit the complete process of EVMs and VVPATs to the court regarding the steps taken to ensure free and fair elections, and a reserved judgment saying that the sanctity of the electoral process should be maintained.
