The Bombay High Court has refused to reinstate a civil judge accused of coming to court in a drunken state. The court said on Tuesday that judges should work with dignity. There should be no such conduct or conduct which affects the image of the Judiciary.

Anirudh Pathak, 52, had filed a petition in the Supreme Court in appeals against his removal as a civil judge (junior division) for alleged misconduct and arriving in court in a drunken state on several occasions. Pathak appealed against a January 2022 order passed by the Maharashtra government’s law and judicial department, removing him from judicial service. This order was passed after submitting the report to the Chief District and Sessions Judge of Nandurbar.

A division bench of Justices AS Chandurkar and JS Jain dismissed the plea and said the order to remove Pathak from service was not found to be wrong and was not passed without consideration. The court said that this is an accepted rule that judges and judicial officers should function with respect. He must not engage in such behavior or behavior that may tarnish the image of the judiciary or is unbecoming of a judicial officer.

The High Court said that if the members of the judiciary themselves behave in a manner that is reprehensible or unbecoming a judicial officer, then the courts cannot give any relief. The judges said in his order, the judges exercise the sovereign judicial power of the state while fulfilling their duties. Therefore, standards are expected to be maintained at a high level. most.
