Certain requirements must be taken into account when drafting contracts for clients and during the procedural support for agreements regarding the registration of rights of use (lease, easement, surfaces, sublease, etc.). This is reported by the Land Fund of Ukraine, writes agronews.ua.
In terms of determining the amount of rent, there is a regulation here:
- normative, established directly in the legislation for a specific type of property;
- contractual, is applied at the discretion of the parties.
In the land lease agreement, it is necessary to clearly prescribe the terms and frequency of considering the issue of changing or indexing the amount of rent. Also, in the period of conflict, it is appropriate to include a condition in the contract regarding the possibility of reducing the payment, if there is an independent complication in the use of the property or the possibility of not paying rent during the time . when a person cannot use the property due to circumstances for which they are not responsible (such as minefields, occupation, etc.).
It is important to note that, usually, unless the parties have agreed otherwise in the land lease agreement, when the owner of the property changes, the lessor’s rights and obligations are transferred to the new owner. These are the main requirements for the lease agreement.
However, land, as a particularly valuable immovable property, can be leased taking into account not only the requirements described above, but also taking into account the requirements of separate legislation that regulates the transfer of such use rights.
