The Bombay High Court reprimanded the Maharashtra government. A division bench of the Bombay High Court consisting of Justice Girish Kulkarni and Justice Firdosh Poonivala heard the petition of Sudhakar Pawar. In the petition, Sudhakar Pawar challenged the government’s order in November 2023, in which the government refused to give compensation of Rs 50 lakh to Pawar for the death of his wife. In the petition, Pawar said that his wife Anita Rath Wood Pawar worked as a nurse at the Sassoon General Hospital in Pune. During the Corona epidemic, Anita was also a part of the Covid-19 fighting team. However, in April 2020, Anita was also infected with Corona, due to which she died.

The Maharashtra government has announced a compensation of 50 lakh

The state government introduced a scheme in May 2020, under which it was announced to provide personal accident cover of Rs 50 lakh to employees engaged in active duty in Corona. Under this accident cover, the employees engaged in active duty like survey, treatment, surveillance and treatment of corona infected were supposed to get compensation of Rs 50 lakh to their families on their death.

The court said – the petitioner is entitled to compensation

The petitioner also demanded a compensation of Rs 50 lakh for the death of his wife under this scheme, but the state government rejected the demand of the nurse’s husband saying that the nurse was already ill before contracting the corona virus. However, in the medical report given by the dean of Sasson Hospital, the nurse was declared perfectly fine before she contracted the corona virus. After the government’s refusal, the nurse’s husband filed a petition with the High Court. At the hearing of the petition, the court said that apparently it appears that the government rejected the demand for compensation without thought and the petitioner seems to be entitled to compensation.
