What are the steps taken in cases of gang killings? Supreme directive to states to respond within 6 weeks Achi-News

NEW DELHI: The Supreme Court has directed various state governments to report within six weeks about the action taken in cases of mob attack and mob lynching in the name of Cow Vigilantism.

A constitution bench comprising Justice BR Gavai, Justice Arvind Kumar and Justice Sandeep Mehta decided to hear the petition of the women’s organization after receiving reports on the steps taken by various state governments in the name of protecting cows in cases of mob attacks and killings in six a week.

The petition sought directions to states to take immediate action in line with the Supreme Court’s 2018 judgment to deal with cases of mob violence against Muslims in the name of cow protection. We find that most of the States have not filed their counter affidavits to the writ petition stating cases of ‘lynching mob’. At least states are expected to answer what steps have been taken in such cases. We will give six weeks time to states that have not submitted their answer. The bench directed all the states to respond within six weeks.

Last year, the Supreme Court had directed a petition filed by the National Federation of Indian Women (NFIW), affiliated to the Communist Party of India (CPI), to the Union government and the director general of police in Maharashtra. Notices were issued to Rajasthan, Bihar, Madhya Pradesh and Haryana and directed to respond to the petition.

During the hearing, advocate Nizam Pasha, who appeared for the petitioner organization, said that there was an incident of mob attack in the name of cow protection in Madhya Pradesh, but an FIR was registered against the victims for killing cows. He asked how the 2018 judgment in the Tehseen Poonawala case would be implemented if the state denied the incident of gang killings.
