The Supreme Court overturned the Allahabad High Court’s decision to grant bail to a police officer accused of raping a minor. Along with this, the Supreme Court ordered the accused police officer to be sent to jail. In fact, the minor victim was allegedly sexually assaulted by four people. The minor victim came to the police station to complain about it , where the policeman also sexually assaulted her.
The Supreme Court overturned the High Court’s decision
The Supreme Court said that there is no reason to see the High Court’s decision as justified. The accused was posted as SHO in the police station and misused his position and committed the heinous crime of rape of a minor. A bench of Justice AS Bopanna and Justice Sanjay Kumar passed this order on the petition of The victim’s mother.The Allahabad High Court had ordered the release of the accused policeman on bail on March 2 last year.
The victim’s mother filed a petition
The judge said that the minor victim went to the police station to seek justice, but there too a heinous crime was committed against her. The bench said that the accused police officer will have to surrender, if he does not do so, the state government must take the necessary steps and take him into judicial custody. Senior advocate HS Phulka appeared on behalf of the victim’s mother. A case was registered against the accused under various sections of IPC, POCSO Act and Scheduled Caste and Tribal Act.
