GUWAHATI: The Supreme Court of India on Monday heard arguments by senior advocate Abhishek Manu Singhvi, who is representing Delhi Chief Minister Arvind Kejriwal, in connection with his arrest by the Enforcement Directorate (ED) in the Delhi liquor policy case. Kejriwal’s petition is challenging his arrest by the ED, arguing that it is illegal and a misdemeanor "An unprecedented attack" On the principles of democracy, especially the right to free and fair elections.

A Supreme Court bench comprising Justices Sanjeev Khanna and Dipankar Datta heard the arguments of Singhvi, who stressed that the arrest was made immediately after the announcement of the Lok Sabha elections and the implementation of the Model Code of Conduct. Singhvi claimed no "New" Evidence justifying Kejriwal’s arrest and that the action was unjustified, suggesting that it was influenced by the political context.

Singhbi presented several arguments in support of his claim of unlawful detention. He pointed out that Kejriwal was not mentioned in the original CBI FIR or the ED Enforcement Case Information Report (ECIR) related to the liquor policy case. Moreover, he stated that the timing of the arrest – coinciding with the announcement of the Lok Sabha elections – raised questions about the ED’s motive.

During the hearing, Singhvi also argued that the ED’s reliance on statements taken from witnesses, especially from Sarath Reddy, who had not earlier mentioned Kejriwal in the nine statements, was questionable. He emphasized that Reddy’s incriminating statement came after he was granted bail and became a corroborator, raising doubts about her reliability.

The bench asked Singhvi if Kejriwal had filed a bail application in the trial court, to which he replied that the current petition challenges the legality of the arrest, not seeking bail. Singhvi emphasized that the Prevention of Money Laundering Act (PMLA) sets a high bar for arrest, which did not meet Kejriwal’s case.

The court ordered that the matter be brought up for hearing on Tuesday.
