The Delhi High Court struck down the circular ban "dangerous" Dog Breeds Achi-News

Guwahati: The Delhi High Court has set aside a circular issued by the Union Ministry of Fisheries, Animal Husbandry and Dairying, Department of Animal Husbandry and Animal Husbandry, which banned the import, rearing and sale of some "dangerous and cruel" Dog Breeds.

A division bench comprising Acting Chief Justice Manmohan and Justice Manemat Pritam Singh Arora quashed the circular issued on March 12 after the Union government’s counsel did not object to its quashing, with a direction to issue a fresh circular after raising objections from all stakeholders.

"In light of the statement of a learned lawyer of the Union of India, the appellant’s circular dated March 12, 2024 is cancelled," the court declared. In light of the impracticality of giving oral hearings to every dog ​​owner, the court ordered the central government to publish a public notice in a national newspaper and on the official website of the ministry, inviting written objections to the proposed notice or the draft notice within two weeks.

"The objections that will be submitted in response to the publication/posting on the website will be examined and decided by the respondents before the final notice is given," The court ordered. The bench disposed of a series of petitions challenging the notification, arguing that the ban was imposed on 23 dog breeds without consulting or seeking objections and suggestions from stakeholders.

However, the court clarified that it did not refer or refer to the recent judgment of the Karnataka High Court, which also struck down the circular. The circular banned breeds such as Pitbull Terrier, Tosa Ino, American Staffordshire Terrier, Fila Brasileiro, Dogo Argentino and others, which required sterilization for pet owners and the cessation of further breeding of the prohibited breeds.
