The Calcutta High Court has declared the OBC status given to many parts of West Bengal since 2010 as illegal. This High Court comment sparked a political debate amid the Lok Sabha elections. Chief Minister and TMC supremo Mamata Banerjee reacted strongly to the court order. She said that she would not accept this order and would challenge it in the Supreme Court. On the other hand, Prime Minister Narendra Modi described the decision The Calcutta High Court as a slap to the opposition claimed that it exposed the ploy of the opposition alliance to give reservations to Muslims under the OBC sub-quota.
Delivering its verdict on the petitions challenging the provisions of the Act on Wednesday, the division bench of Justice Tapabrata Chakraborty and Justice Rajashekhar Mantha said that the services of citizens belonging to disadvantaged sections, who are already in service or have availed the benefits of reservation. The decree will not affect the state election process.
The court struck down several categories of reservations given as Other Backward Sections (OBC) under the West Bengal Backward Classes (other than Scheduled Castes and Scheduled Tribes) (Reservation of Vacancies in Services and Posts) Act, 2012. The commission ordered that the state executive orders from March 5, 2010 to 11 May 2012, classifying several other castes as OBC, were also quashed in light of the illegality of the reports recommending such classification.
