A hearing was held in the Supreme Court to settle issues related to the orders passed by civil bodies regarding stray dogs. During the hearing, the Supreme Court said that there is no hesitation in settling these issues, but it will not be possible to expand the scope of the case in question. The court said that the parties should study the Animal Contraception Rules 2023 as they can solve many problems.

A bench of Justices JK Mahashwari and Sanjay Karol said the court has no hesitation in regulating the issue but will not allow its scope to be expanded. The bench said that Animal Contraception Rules 2023 have now been implemented and its rules have to be studied. During it, a lawyer said that it is possible that the bench will give time to read these rules and after studying them we will return to the court. The court said that the root of the matter can be reached only after a thorough understanding of the rules.

Another lawyer said that an advisory was recently issued by the Animal Cruelty Council to implement the Animal Contraception Rules 2023. If these are read carefully, 90 percent of cases can be resolved. The court said that if maximum problems are solved after learning the rules, then we can handle the problems according to law. Even after that, if certain problems arise, the parties may turn to the High Court. Now this issue will be discussed in court on May 8.

What did the court say in September 2023?

During the hearing in September 2023, the Supreme Court said that it does not want to give interim instructions in this matter. The court said that a decision will be taken only after studying the relevant laws, rules and issues. During this, a lawyer said that various comments have been made in this regard by the high courts of various states. During the hearing, the Supreme Court asked the Animal Welfare Council to submit an affidavit. The affidavit was also requested to attach the data on the bites of stray dogs during the last years in different countries. The Supreme Court said that there is a need for a balance between human safety and animal rights.

In fact, several institutions and petitioners appealed to the Supreme Court against the decisions of some of the higher courts. Notably, the high courts of Bombay and Kerala have allowed municipalities to take steps to deal with stray dogs, subject to rules.
