The Supreme Court on Friday sought a response from the Center and the Assam government on a fresh petition challenging the Citizenship Amendment Act (CAA). A bench of Chief Justice DY Chandrachud and Justice JB Pardiwala gave these directions after considering the petition filed by Hiren Gohain, a resident of Guwahati.
The Supreme Court has sought answers from the central government of Assam
Gohain said in his petition that the Citizenship Amendment Act is unconstitutional. This is clearly discriminatory, illegal and contrary to the basic structure of the Constitution. After hearing the arguments of a lawyer appearing in court on Gohain’s behalf, the Supreme Court issued a notice to the state government and the Union Ministry of Interior. The Supreme Court also ordered to attach the new petition with the pending petitions on the subject.
What was said in the petition?
Gohain noted several special points in his petition. According to him, he filed this petition on behalf of the people of Assam. While raising the issue of the flow of illegal immigrants from Bangladesh to Assam, the petition said that it was not a communal issue nor an issue of Hindu-Muslims or natives versus Bengali immigrants. The petition states that this is infiltration. Those infiltrators who are illegally occupying the land of the original Assamese people.
