The 5th edition of the Courts and Constitution Conference was held at NALSAR Law University, Hyderabad. The opening session of the program was addressed by Supreme Court judge Justice BV Nagarathna. During this, referring to the Governor of Punjab, he warned the governors against unlimited obstruction of the bills passed by the elected representatives.
He also mentioned the Governor of Maharashtra in the Constituent Assembly. He said he didn’t have enough material to declare the floor test. According to him, bringing the actions or omissions of a state governor to the courts for discussion is not a healthy trend in law. Justice Nagarathna further said that I should approach the governor’s office because it is a constitutional duty. The governors must fulfill their duties according to the constitution, thereby reducing this type of litigation in court. Asking the governors to do or not do something is quite shameful. Governors should work according to the constitution.
expressed disapproval of demonetisation because
Apart from this, Justice Nagarathna also gave the reason for expressing dissent on demonetisation. He said that I expressed my disapproval against this move of the central government because the common man had to face a lot of trouble because of it. I thought the ban was the alleged attack by the Indian government against black money. The government demonetized 500 and 1000 rupee notes, which accounted for 86 percent of the total currency. 98 percent of the old notes were returned to the banks but what happened next regarding the action of the income tax department. The common man was very upset due to this decision of the government. Because of the plight of the common man I had to express my disapproval. It is worth noting that the Constitutional Bench of the Supreme Court approved the validity of the demonetization plan in 2023 by a majority of 4:1. Only Justice Nagarathna dissented in the case.
A Pakistani judge also spoke at the conference
At the conference, speeches were heard by the judges of the Supreme Courts of Nepal and Pakistan – Justice Sapna Pradhan Malla and Syed Mansoor Ali Shah. Also, Telangana High Court Justice Alok Arad and NALSAR Chancellor Justice S Ravindra Bhat also addressed the conference.
