Lucknow: The Allahabad High Court has given an important order that no Muslim man who follows the religion of Islam has the right to live in a live-in relationship, Islam does not allow such relationships.

The order was passed by a division bench comprising Justice AR Masudi and Justice AK Srivastava I of the Lucknow bench of the Allahabad High Court hearing a writ petition filed by Sneha Devi and Mohammad Shadab Khan. In the petition, both the petitioners had applied to quash the FIR registered in this case and to provide security while in a ‘live-in relationship’.

In its order, the Lucknow bench of the Allahabad High Court said that customs and traditions are equal sources of law and Article 21 of the Constitution does not recognize the right of a relative to be limited by customs and traditions. The court also ordered the police to return Snehadevi to her parents under security.

The petitioners told the court that they were adults and that they were living in a ‘live-in relationship’ of their own free will. Despite this, the young girl’s brother lodged an FIR at Visheshwarganj police station in Bahraich alleging that she was kidnapped. Challenging this FIR, the petitioner had sought an order not to interfere with the peaceful life of the petitioner.

During the hearing of this case, the applicant Mohammad Shadab Khan was married to Farida Khatoon in 2020. It also emerged before the court that the couple had a daughter. Farida Khatoon currently lives in Mumbai with her parents.

After considering the facts of the case, the Court decided that Article 21 of the Constitution does not confer a right to protection in cases where custom and custom prohibit people of different faiths from performing any act because Article 13 of the Constitution also recognizes custom and tradition. . The court said that since Islam does not allow a married Muslim person to live in a live-in relationship, the petitioner is not entitled to security while living in a live-in relationship, especially when he has a spouse.
