Bengaluru: Can pepper spray be used in a dangerous situation? Is using pepper spray a legal defense? Yes, there are huge discussions about the use of pepper spray whenever there is violence against women in the country.

What does the High Court think?
However, the recent opinion of the Karnataka High Court is contrary to this and opined that pepper spray is a dangerous weapon and no law has been framed for its use. The High Court said that in a country like America, using pepper spray is considered harmful chemical spraying.

Prajavani reported that a one-member bench headed by Justice M. Nagaprasanna dismissed the writ petition filed by C. Ganesh Narayan, director of jewelery store C. Krishnaiah Chetty & Sons and his wife Vidya Nataraj. The director of C. Krishnaiah Chetty and Sons Company and his wife had filed an application to quash the investigation of the criminal case against them.

The applicant said the pepper spray was for personal safety. However, the court said that such a statement should be investigated under the Evidence Act and the truth should come out. When they came to seal a case related to a restraining order, they sprayed the workers who came with pepper spray. The staff who were subjected to the pepper spray attack had complained against this.
