The Madras High Court on Tuesday refused to quash the three-year jail term awarded to former Tamil Nadu Special Director General of Police Rajesh Dass in a sexual assault case. Justice M Dhandapani, while dismissing various petitions, also refused to grant exemption to Das from surrendering before the trial court.

Das was convicted by a local court in Villeform in 2021 for allegedly sexually assaulting a female police officer. The court sentenced him to three years of rigorous imprisonment.

The judge said that in cases concerning the violation of women’s dignity or indecent behavior with them, the courts must be very careful and act slowly while canceling the defendant’s conviction. According to him, the current case concerns a person who held a very high position in the police.

According to him, the police is a disciplined force, where people in senior positions should demonstrate high discipline and they should present themselves as role models for the citizens of the country.

The judge said that in this case the petitioner for correction was accused of inappropriate behavior with a female employee under him. When the general public misbehaves with women, these officers take action. The judge said he was greatly appreciated for performing his duty without any fear or favor.

The judge said that this court is considering overturning the sentence. But the contradictions pointed out by the petitioner were not of a positive nature. Moreover, the case in the lower courts is based on evidence. The judge said that in such cases the court is obliged to consider the evidence of the victim to verify whether the evidence is reliable or not.
