Bombay High Court: In a petition submitted to the court, the woman demanded that her conjugal rights be restored. The court said that the woman filed a false police report against her husband and in-laws, which amounts to cruelty.

The Bombay High Court refused to set aside the divorce decree granted to the couple by the Family Court. In this case, the court also said that filing cases against husband and mother-in-law with the help of lies amounts to cruelty. In fact, a petition was filed by a woman to the High Court. In the petition, the woman demanded that her rights in marriage be restored. In addition, the divorce order passed by the Family Court was also appealed. The woman’s husband sought a divorce on the grounds of cruelty on the part of his wife.

In his order, Judge Y.G. Khobargade pointed out that initiating action according to the domestic violence law and demanding the restoration of conjugal rights are not cruel in themselves. But the filing of a false and baseless police report by a woman against her husband and mother-in-law definitely falls within the ambit of cruelty.

The woman’s husband made this claim

The woman’s husband claimed that they both got married in 2004 and then they both lived together until 2012. In 2012, his wife returned to her parents and started living with them. Several fake criminal cases were filed by the woman against her husband and in-laws. A petition was then filed by the husband against the wife in the family court. The petition states that due to the cases registered based on lies he had to suffer mental harassment. It was also claimed by the husband that his wife filed false cases of abuse against his father and brother. In this way the whole family remained mentally disturbed and also lost their respect in society.

The order of the lower court is absolutely correct – the High Court of Justice

The woman claimed in court that she was harassed by her father-in-law and hence a complaint was filed. The court stated that there was cruelty on the part of the woman and the order of the lower court was absolutely correct. The High Court rejected the woman’s petition saying that there is no problem with the lower court’s order to grant a divorce.
