I am grateful to the District Bar Association and the organizers of this program for providing an opportunity to discuss and exchange ideas with intellectuals and thinkers. First of all, I would like to express my happiness and joy that the title of this program “Current Laws: In the Eyes of Islam” is a very important topic and it is very important for lawyers and scholars to sit together and think about it. . I have been saying for a long time that we should come together, and for me the biggest problem we have at the moment is that we have two areas of law: one area of ​​the legal system, and one area of ​​the beliefs of people of Faith , love and devotion, these two realms are different, until these areas are not united, the legal and social system of the country will not be on the right track. I have been saying for almost forty years that there must be an adjustment in both areas. Unless the scholars and the lawyers come together to solve the social and legal problems and try to bridge this gap through mutual consultation, the conversation will not be done and we will not be on the right track. Therefore, I will express happiness that a good idea was born. May Allah, the Most High, give us the opportunity to sit together and use the sources of law and Shariah through mutual consultation so that we can provide the right path to the nation together.
I have been given the title of the talk “Comparative Assessment of Interest and Profitability” and I will discuss it in two or three contexts:
The first suggestion is that the Holy Quran has also discussed it in two or three places, but the Holy Quran does not compare usury and profit, but the Holy Quran has compared usury to charity. Profit has been compared by the Holy Qur’an to the deterioration of the measuring pool and commercial dishonesty, I would like to quote a few verses on this.
It has been said in one place in the Qur’an, “Yamhaq Allah Raba Wirbi al-Sadaqat” (Al-Baqarah 276). This is the comparison between usury and sadaqah. I will give a small example. See, money seems to increase with interest and decrease with charity. If the interest rate is ten percent, then from one hundred to one hundred and ten, and at least two and a half percent is reduced by charity, so it will continue from one hundred to ninety eight. So the apparent scenario is that interest increases money and charities decrease. But Allah Almighty says that this is not true, rather, money decreases with interest and increases with charity. This is a clear and categorical statement from the Holy Quran.
As an indication of this, I would like to state that one is a count and one is a value. Account is one thing, value is another. Interest increases the account, decreases the value. While the value of a charity increases, the count decreases. For example, I got married in 1970, I made jewelery and bought one hundred and seventy rupees tola of gold from Sarafa Bazaar in Gujranwala, but today the price of one tola of gold is two lakh. The account has gone from 170 to 220,000, while the value is one tola of gold.
Note also that an increase or decrease in value is not in the power of the man who has the money in his pocket, but in some other power. There are some forces that keep the value down. For example, I have a five thousand note in my pocket, it is controlled by someone else. Whether it becomes five thousand, seven thousand, or three thousand, I have no control over it. Similarly, it is in the power of Allah to create blessings or to give unblessings in wealth, and Allah Almighty has declared this principle: “Yamhaq Allah al-Raba Weerbi al-Sadaqat” (Al-Baqarah 276). Create blessings. In the second place, Allah Almighty has explained it in a more comprehensive way, “Wama atitatum min riba lerbu fi amwal nas, fila yerbua and Allah, wama atitatum min zakaat taridoun raadiun Allah fawlaik hum al-muzafaun” that you take interest with the intention that the amount will increase. , it does not increase in the sight of Allah, and what you give as Zakat for the sake of Allah, in fact, it increases. Here too, Allah, the Most High, has not compared usury to profit, but has compared usury to charity and zakat.
