Supreme Court Justice DY Chandrachud said a delicate balance must be maintained between the search and seizure powers of investigative agencies like the Central Bureau of Investigation (CBI) and an individual’s right to privacy. Justice Chandrachud said this at the 20th DP Kohli Memorial Lecture in memory of the first director of the Federal Investigation Agency.

During his speech, Judge Chandrachud said that a delicate balance must be created between search, seizure of powers and individual privacy rights. This is the cornerstone of a fair and just society. In his address, he emphasized the need to maintain a fair procedure at the core of this balance.

Justice Chandrachud said of unfair seizure of personal devices

Chief Justice Chandrachud also mentioned in his speech the unfair seizure of personal equipment. According to him, there is a need for a balance between investigative needs and personal privacy rights. However, he also asked the investigating agencies to fight their battle. According to him, instead of spreading many cases in too much detail, they should focus on those crimes that pose a threat to the country’s security, economy and public order.

Referring to the crime scenario, Justice Chandrachud said that investigative agencies like the Central Bureau of Investigation (CBI) should build their capabilities to deal with them apart from using artificial intelligence (AI) tools. In his speech, Justice Chandrachud said that as our world becomes increasingly interconnected through the expansion of digital technology, investigative agencies like the CBI are facing new and difficult challenges.

CJI Chandrachud praised the new criminal laws

Chief Justice of India DY Chandrachud on Monday praised the new criminal laws passed by the government to replace the British-era laws, calling it “an important step towards modernization of the judiciary”. He said the Indian Civil Code (BNS), Indian Civil Defense Code (BNSS) and Indian Evidence Act (BSA) provide a comprehensive approach to ensure unhindered flow of evidence. Their purpose is to enable better coordination and cooperation between the stakeholders involved in the investigation and judicial processes.
