The central government on Thursday told the Supreme Court that the Center has no control over the CBI. In fact, the West Bengal government had filed a petition in the Supreme Court alleging that the CBI had not taken the permission of the state government for investigation in many cases. In fact, the West Bengal government filed a case against the Center in the Supreme Court under Article 131 of the Constitution. It claimed that even though the state has withdrawn the blanket consent given to the CBI, the federal agency is investigating the state’s cases by registering an FIR.

Article 131 of the Constitution deals with the jurisdiction of the Center and the states. Legal advisor Tushar Mehta, appearing in the Supreme Court on behalf of the central government, told the bench of Justice Bar Gwai and Justice Sandeep Mehta that Article 131 of the Constitution is one of the most sacred jurisdictions of the Constitution and its provisions cannot be misused. . Mehta said the case mentioned in the state government’s lawsuit was not filed by the Indian government. Mehta said the case was not registered by the central government but by the CBI. CBI is not under the control of Government of India. It is noteworthy that on November 16, 2018, the Bengal government withdrew the permission given to the CBI to investigate in the state. After that CBI cannot raid or investigate in Bengal.
