In the case of the death of two youths and injuries to others during the incident of violence at Daribit High School in West Bengal’s North Dinajpur district, a division bench of the Calcutta High Court asked the state government to implement the order of the single bench. where the event took place. Instructions were given to hand over the investigation to the NIA.

The West Bengal government should transfer the investigation to NIA – the court

A bench headed by Chief Justice TS Sivagnanam refused to grant any interim stay on the single bench order while agreeing to hear the West Bengal government’s appeal challenging the transfer of the investigation to the NIA. The division bench directed the state to implement the single bench order of transferring the investigation to the MLA without wasting time.

Instructions were also given for providing compensation to the families of the deceased and injured.

Since the NIA’s request to hand over certain documents through a letter to the Additional Director General, CID in May 2023 has not yet been answered, the court directed the state’s Criminal Investigation Department to do so within a week. It also directed the state government to pay compensation to the families of both the deceased and the injured, at the appropriate rates , within a period of three weeks from the date of issuance of the single bench order.

What does it matter

Notably, on May 10, 2023, the single bench ordered an NIA probe into the death of two youths in an alleged firing and bombing during a demonstration at Darvith High School in North Dinajpur district in September 2018. Justice Rajeshkhar Manta also ordered the West Bengal Govt. to pay compensation to the families of the two deceased and injured in the incident within two months.

College student Tapas Burman and ITI student Rajesh Sarkar were killed violently during protests over recruitment of Sanskrit and Urdu teachers. The locals claimed that the school needed math and science teachers and not language subjects. Following allegations of police firing during the incident, the state government has transferred the investigation of the case to the state CID.
