The Bombay High Court has given an important comment regarding the renewal of the driving license. The High Court said on Tuesday that the additional fee charged for renewal of driver’s license and motorcycle registration certificate after the deadline does not constitute a penalty. However, the bench of Chief Justice DK Upadhyay and Justice Arif Doctor upheld the rules laid down under the Central Vehicles Act. The bench heard petitions filed by two trusts related to the transport sector – K Savakash Autorickshaw Association and Mumbai Bus Malaks Sanghatana.Thus both the trusts challenged the validity of the rules of the Central Vehicle Act.
In their petition, the two trusts argued that the provision imposing an additional fee is actually a fine disguised as a fee. and no further service is provided through this.
To this, the High Court bench said, while rejecting the petition, that we have no hesitation in accepting that imposing an additional fee for renewing the driver’s license and the motorcycle registration certificate after the deadline will not be done directly or indirectly. Punishment M. The committee said in its order that according to the provisions of the law, the government has Right to impose additional fees.
The court said that the central and state governments have been empowered to levy fees for certain functions like correction of documents, issuance of certificates, licenses, permits, inspections etc. The High Court emphasized that a late application for the renewal of a driver’s license or the reissuance of a vehicle registration certificate should be considered a service. This is work of a regulatory nature.
