Another consensual sex between two adults even though they are married is not wrong: the verdict of the High Court Achi-News

NEW DELHI: According to social norms, sexual relations should ideally take place within the framework of marriage, but there is nothing wrong if two adults have consensual sex irrespective of their marital status, said a Delhi High Court Verdict.

While granting bail to a married man accused of rape, the Delhi High Court has expressed an important opinion on the matter, a woman had alleged that he had raped her on the pretext of marriage. The court said that the victim’s decision to continue the relationship even after knowing prima facie about the marital status of the accused referred to her consent and no evidence was shown to confirm that the accused continued with her under any circumstances compulsion.

The court said that it was clear that the woman was courting the accused for a long time before filing the complaint and that she wanted to continue their relationship even after knowing that the petitioner was a married man.

Delhi High Court Justice Amit Mahajan said in an April 29 order in the case that although social norms dictate that sexual relations should ideally take place within the framework of marriage, consensual sexual activity between two adults, regardless of their marital status, be. it is said to be unjust.

The court, in its order, noted that the FIR was filed almost fifteen months after the first alleged incident and that the complainant had not provided any evidence of coercion. The court decided that, although the alleged crime was heinous in nature, the fact that the purpose of the prison was not punishment but its purpose was to ensure the presence of the accused during the trial could not be ignored.

False allegations of sexual harassment and coercion tarnish the reputation of the accused, as well as the credibility of genuine cases. It is therefore necessary to be very diligent in evaluating the prima facie allegations against the accused in each case, especially when there is a dispute about issues of consent and intent. The court ruled that the petitioner, aged about 34, survived by his wife and two small children, had been in custody since March 2023, in such a situation, there would be no purpose in being kept in prison .
