Strict instructions to Bihar Govt
State Chief Justice (CJI) Justice DY Chandrachud lashed out at the Niti Bihar government on Monday hearing the case of Patna High Court judge Justice Rudra Prakash Mishra who has not received salary for several months. Taking a serious stand with the state government, Justice Chandrachud’s bench gave strict instructions to the Bihar government to open a temporary General Provident Fund (GPF) account for Justice Mishra and release his pending salary.
Justice Mishra was sworn in as a Patna High Court Judge last year on November 4, 2023. He was appointed from the Judicial Services Quota, but due to the absence of a GPF account he was not paid his salary.
We will pass interim orders
Justice Rudra Prakash Mishra was elevated from the District Judiciary to the Patna High Court on November 4, 2023. He is not getting his salary from the date of his promotion as he does not have a GPF account, which is a pre-requisite for drawing salary as a High Court Judge. Judges of subordinate courts are covered under the pension scheme the new (NPS) and therefore they do not have GPF accounts. Judge Mishra could not receive his salary as High Court judges are not covered under the MLA. The bench asked: “Why do they not receive their salaries? what is this We will pass an interim order to release their salaries.”
The committee said it would direct the Bihar government to open a temporary GPF account for Justice Mishra. Attorney General Tushar Mehta, appearing in the Supreme Court on behalf of the Center, asked for time until Friday and assured the committee that the matter would be resolved by then.
