Now the High Court of Madhya Pradesh (High Court of Madhya Pradesh) has given an important decision. A man should also give support to a woman who is with him without marriage. The court said that the man should give support to the woman in this relationship as in a divorce.

What is the cause?

The Madhya Pradesh High Court has ruled that a woman who has lived with a man for a sufficient period of time is entitled to maintenance after separation even if she is not legally married. In one case, the trial court had ordered that a woman in a live-in relationship be given a monthly allowance of ₹1,500. The petitioner questioned this in the High Court. But the High Court upheld the order of the trial court.

The High Court referred to the finding of the trial court that the man and the woman lived as husband and wife. The judge emphasized that alimony cannot be denied if there is proof of cohabitation between the couple. Considering the birth of a child within the relationship, the court decided that the woman’s maintenance should be paid.
