Supreme Court Stays Allahabad High Court Verdict On Madrasa Board Act Ac Un Constitutional – Amar Ojala Hindi News Live Achi-News

The Supreme Court stayed the order passed by the Allahabad High Court on March 22. In its order, the Supreme Court declared the ‘UP Board of Madrasa Education Act 2004’ as unconstitutional. The Supreme Court said that it is wrong for the Allahabad High Court to say that the Madrasa Board violates the secular principle of the Constitution. Along with this, the Supreme Court also stayed the adjustment process of 17 lakh students and 10 thousand teachers of the Madrasa Board in other schools. A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra Also issued notification to Central Government and Uttar Pradesh Government in this regard.

The High Court declared it unconstitutional

A lawyer named Anshuman Singh Rathore filed a petition in the High Court challenging the constitutionality of the UP Madarsa Act, on which the High Court ordered to strike down the Madrasa Act considering it unconstitutional. The division bench of the High Court comprising Justice Vivek Chaudhary and Justice Subhash Vidyarthi said in its order that “the government has no power to constitute a religious education committee or to establish a school education committee for any particular religion.” The Lucknow bench of the Allahabad High Court, in its order, directed the state government Accommodate the students studying in state madrassas in other schools.

The Supreme Court also said in its order that the Madrasa Act also violates Section 22 of the ‘University Grants Act (UGC) 1956’. According to media reports, there are 16,513 registered and 8,449 unregistered madrassas operating in Uttar Pradesh. About 25 lakh students study there.
