The Supreme Court on Friday defined the instructions of the Madras High Court as unfair and inconsistent. In fact, the High Court ordered YouTuber Felix Gerald to close one of his channels ‘Redpix 24×7’ as part of the conditions for granting bail.

The Supreme Court also upheld its September 6 order granting bail to Gerald. On September 6, the Supreme Court stayed the order of the Madras Supreme Court, which ordered the YouTuber to close the channel as a condition for granting bail.

Other conditions will need to be met: Bench

A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra issued a notice to the state government leaving the specific direction to close the channel. However, the court asked him to comply with other bail conditions.

The commission approved the September 6 bail order after hearing the arguments of senior advocate Gopal Shankarnarayan, who appeared on behalf of the YouTuber. The bench said that following its earlier order, Gerald has already been released on bail. The Supreme Court said that one of the bail conditions, which asked him to close his YouTube channel, was unreasonable and disproportionate and therefore we removed this condition. However, other conditions must still be met.

Gerald was arrested for airing an ‘objectionable’ interview of YouTuber Savukku Shankar on his YouTube channel. Shankar made some comments during the interview against Madras High Court judges and policewomen in the state. While granting bail to the two YouTubers, the Supreme Court asked Gerald to shut down his channel as a condition.

The Chief Justice said on September 6, “You make libelous accusations against the judiciary and all the female officers of the Shavas. Why do you do interviews like this?’ The defense attorney appearing on behalf of the YouTuber said that such an interview should not have been shown.

The senior lawyer also said that the channel has 24 lakh ‘subscribers’ and the direction to close it is difficult. The bench said it would not connect Gerald’s plea with the pending petitions filed by Sabuko Shankar.

Earlier, Shankar had moved the Supreme Court against his arrest by the state police. The court on August 30 asked the Tamil Nadu government to inform it about the reasons for Shankar’s detention immediately after his release in connection with several criminal cases.

Arrested on April 30

Shankar, 48, was arrested by the Coimbatore police on May 4 in South Theni for allegedly making derogatory statements about women police officers in an interview to a YouTube channel on April 30. The Theni police also registered a case against the YouTuber for alleged possession of “ganja”. Shankar was released following the orders of the Supreme Court and the Madras High Court, but was again arrested by the state police on August 12.
