The Supreme Court upheld the acquittal of a 96-year-old ailing convict, who had served a life sentence and is now on parole, in the 1993 Rajasthan train blast case. The Supreme Court bench comprising Justice Abhay S Oka and Justice Ujwal Bhuyan, while hearing the petition of bomb blast case convict Habib Ahmed Khan, directed the Rajasthan government to look at it from a humanitarian perspective.
It is worth noting that Habib Ahmed Khan demanded a permanent release on parole from the Supreme Court with reference to his deteriorating health and age. The petitioner’s lawyer told the Supreme Court that he has been in prison for more than 27 years. He was subsequently paroled three times. From time to time this court extends the third suspended sentence. In such a situation, he should be given permanent parole.
The bench then, after perusing Habib Ahmed Khan’s medical reports, asked Additional Solicitor General Vikramjit Banerjee, representing Rajasthan, to consider his apology and look at the matter from a human rights perspective. The bench also said, ‘Just look at his medical report, where will he go? This is the worst. Yes, he has been convicted of a terrorist crime but he has not been given the death penalty. For him, continued imprisonment is tantamount to a death sentence.
