In Kerala, Chief Minister Pinarayi Vijayan’s government has issued a notification to speed up the land acquisition process for the Sabarimala Greenfield Airport. The Supreme Court stopped further actions in this order. After the High Court’s stay order, currently the state government will not be able to take any further steps regarding land acquisition. The court passed the order on Thursday following a petition filed by Ayana Tzada.

Question about the ownership determination process

The trust petition challenging the validity of the land acquisition notification for the proposed greenfield airport at Sabarimala claimed undisputed ownership in the Cheruvali estate earmarked for the airport. In the delay order handed down by Judge Vijo Avraham, questions were raised about the validity of the procedure for determining the ownership of the land. According to the report, in March last year, the government issued a notice after purchasing more than a thousand dunams of land from 441 account holders. Additional proceedings were discontinued due to procedural concerns.

In the petition submitted to the High Court, Ayana Trust claimed undisputed ownership of the Cherobli estate intended for the construction of the airport. He claimed that the announcement of the purchase of the land from the government is illegal. The government does not accept their ownership, in such a situation the purchase of the land also becomes illegal.

Notice of compensation according to the age 11 law

It is worth noting that in a notice published on March 13, 2024, the government required the purchase of 1000.28 dunams of land for the airport. This includes 2264.09 dunams of land in Cheruvali Estate as well as land in the villages of Aromali Darom and Manimala. According to the government, compensation will be given to the land owners according to the Land Acquisition Law from 2013. The notice was published with the details of the land to be acquired. The special tehsildar of Kutime became the collector and the deputy collector the program manager for the acquisition process.
