Petitions were filed on behalf of 30 doctors in government service. It was alleged that the state government did not provide the benefit of 30 per cent reservation to medical officers, demonstrators and teachers working in district areas. He was removed from the priority list. The basis for their expulsion was recently made by the state government in the amendment to the Medical Admission Rules, 2018.
Advocates Aditya Sanghi and Siddharth Rathelal Gupta told the court that on July 26, 2022, the admission rules were amended. Till then petitioners are eligible for 30 percent reservation. He had cleared the NEET exam. It was argued that the admission process for this session 2022-23 has already started with the NEET exam.
After the exam results were declared, the state government at the Center illegally changed the rules and made more than 50 doctors ineligible for reservation. It was also argued that the principles laid down by the Supreme Court are clear that once the process of admission begins, the rules applicable to it cannot be amended midway.
