This observation was made by a bench of Chief Justice DY Chandrachud and Justice Manoj Mishra regarding the decision of the Bombay High Court, filed by the City and Industrial Development Corporation (CIDCO) and Navi Mumbai.

In 2003, 20 dunams of land were allocated for a sports complex in Navi Mumbai. In 2016, CIDCO, the planning authority of Navi Mumbai, allotted a portion of this sports complex to a private developer, on which residential and commercial construction was to take place.

The government decided to shift the site of the sports complex to Mangaon in Raigad district, 115 km from Navi Mumbai. Against this, the Indian Institute of Architects, Navi Mumbai Centre, filed a case in the Supreme Court challenging the state government’s decision. This is a very common practice, the Supreme Court said. During a brief discussion of the case, the government invades any remaining green space and gives it to the builders.

The CJI said there is very little greenery left in cities like Mumbai and Navi Mumbai. Vertical development took place in these cities. Such green areas should be preserved and not given to builders for construction. The Supreme Court bench was also surprised to find that the land given for a state-level sports complex was given for some development and the proposed facilities were shifted to Reiger district.

The Supreme Court wondered, who would travel 115 kilometers to use the facilities of a sports complex? After a few years, the same land will suffer the same fate. The bench asked sarcastically how will the gold medal winners arrive in such a situation? Attorney General Tosher Mehta, appearing in court on behalf of CIDCO, criticized the High Court’s order and said that he wants to carry out city planning activities, which are under the authority of the state.

Legal advisor Tushar Mehta said that twenty dunams of land is not enough to build a sports complex. In return, the state designated this land as an alternative site. According to him, this matter is not related to green lungs of cities, but it is related to city planning activity. The committee has now set September 30 for the next hearing on the petition.
