The judiciary has broad shoulders and can take praise as well as criticism in its stride, but the recent tendency among lawyers to comment on pending cases is deeply troubling, said Chief Justice of India DY Chandrachud.

Officers and members of the bar should not forget while reacting to judicial decisions that they are officers of the court and not laymen, he added. The CJI was speaking at the High Court Bar Association’s centenary celebrations in Nagpur on Friday.

The judiciary has time and again stood up to assert its independence and non-partisanship, said CJI Chandrachud. “We must not forget, however, that there is a close connection between the independence of the judiciary and the independence of the bureau,” he said.

The bar as an institution is essential for maintaining judicial independence, constitutional values and the dignity of the court, the CJI added. In a vibrant and contentious democracy like India, most people have ideologies or political leanings, Chandrachud noted.

“To quote Aristotle, human beings are political animals. Lawyers are no exception. However, for members of the bar, a person’s highest interest should not be in partisan interests but in the court and the constitution,” he said.
