Trinamool Congress (TMC) leader Mahu Moitra is contesting from Krishnanagar Lok Sabha seat in West Bengal. During the election campaign she constantly talks about her removal from the Lok Sabha. In such a situation, a petition was filed against him by the lawyer Jai Anant Dehdri, on which the Delhi High Court said that he cannot be prevented from defending himself.

The Delhi High Court on Monday said Mahua Moitra cannot be prevented from defending herself against the allegations made publicly by one of her friends.

High Court on Dehdri’s petition

The bench heard oral arguments while disposing of a petition by Advocate Dehdri. The lawyer sought an interim order to stop the suspended Lok Sabha member Mahu from making defamatory statements against him. Dehdri filed a suit against Moitra seeking compensation of Rs 2 crore for making several defamatory statements The evil against her in the case of asking questions for money.

Moitra was expelled from the Lok Sabha on December 8 following allegations by the prosecutor that she took bribes from businessman and Hiranandani Group CEO Darshan Hiranandani to ask questions in Parliament.

Cannot make false statements

Justice Pratik Jalan said during the hearing that if you make allegations in public then they have every right to defend themselves. But she cannot make objectively false statements. If both sides say that we will not put this fight into the common domain, then that is another thing. But if you make public comments, they should also have a chance to defend themselves.

The court said, ‘Given the nature of the relationship between the two in the past, it is normal to think that the other person was wrong but the parties have brought the public debate to an extremely low level. For making false statements against someone, we should pass a restraining order against them. I appeal to their common sense. Both sides are educated.
