Delhi High Court dismisses petition to remove jailed Arvind Kejriwal as Chief Minister Achi-News

GUWAHATI: The Delhi High Court on April 4 dismissed a petition seeking the removal of Arvind Kejriwal as Delhi Chief Minister while he remains in Tihar Jail after his arrest in a liquor policy case. The division bench of the Delhi High Court ruled that it was Kejriwal’s personal decision whether to continue as chief minister or not.

This is the second time that the Supreme Court has rejected a petition seeking Kejriwal’s removal from the post of Deputy Chief Minister of Delhi. The court advised the petitioner to approach the constitutional authorities with their concerns, stressing that it is the power of the Lieutenant Governor or the President to handle such matters.

The petition was filed by Vishnu Gupta, the national president of the Hindu Sena, who subsequently withdrew the petition and stated his intention to make a presentation to the Lt. Governor. Gupta’s lawyer claimed that Kejriwal’s arrest resulted in "lack of government" in the national capital.

In response to the petition, the High Court of Justice ruled that it does not have the authority to declare the government non-functioning, as this authority rests with the LG. The court emphasized that the LG was fully authorized to make decisions in accordance with the law without being required to be guided by the judiciary.

Meanwhile, Kejriwal, despite being under arrest, directed AAP MLAs to visit their constituencies daily and ensure that the people of Delhi face no hardship. Kejriwal’s wife Sunita Kejriwal conveyed his message during a digital briefing.

Kejriwal, who is in judicial custody till April 15 in connection with a money laundering case, reiterated his commitment to serve both the people of Delhi in messages sent through his wife. He emphasizes various initiatives, including giving monthly recognition to women and dealing with issues related to water, health and infrastructure in the city.
