Delhi CM sent to jail again, High Court shocks Kejriwal who was awaiting bail! Achi-News

New Delhi: Delhi Chief Minister Arvind Kejriwal has faced a huge setback again. The Delhi CM, who was expected to get bail and come out of jail, got a shock on Tuesday.

The Delhi High Court has continued the suspension order on the bail granted to Arvind Kejriwal by the lower court, forcing Arvind Kejriwal to spend time in jail again. A lower court had recently granted bail to Kejriwal. Challenging this, the Enforcement Directorate filed an application in the High Court. Now the High Court has rejected the European Division’s appeal.

Arvind Kejriwal was arrested by the ED on March 21 in a money laundering case related to the Delhi liquor policy scam case. Kejriwal was recently granted interim bail till June 1 by the Supreme Court to campaign for the Lok Sabha elections. After this, he surrendered on 2 June. The Supreme Court then advised him to go to the lower court for bail.

Kejriwal had filed a bail application in the lower court on the directions of the Supreme Court. In this context, the court has granted him bail. However, the Enforcement Directorate challenged the bail decision in the Delhi High Court. Later, during the last hearing, the High Court suspended the bail. Kejriwal had moved the Supreme Court against this ban. However, the Supreme Court told us to wait until the High Court’s order. Now the High Court has continued the stay on bail.

The Delhi High Court on Tuesday (June 25) ruled on the petition filed by the Enforcement Directorate. A bench headed by Justice Sudhir Kumar Jain stayed the judgment of the Rouse Avenue court. The court while hearing the case said that the vacation bench of the lower court did not exercise its discretion in granting bail to Kejriwal. The High Court said that we had heard both arguments, but the lower court did not consider the records of the Enforcement Directorate. The lower court ruled that the two requirements of Section 45 of the PMLA had not been considered.

The Delhi High Court said Additional Solicitor General Raju on behalf of the ED said that the lower court had said in its order that so many documents could not be read. Such comments are completely inappropriate and show that the trial court did not pay attention to the record. After the election, Kejriwal was granted bail. After the high court rejected his plea to arrest, the high court said that his liberty cannot be said to have been violated.

ED standing on lower court ruling?

ED has challenged Kejriwal’s bail order in the Delhi High Court. The ED said the lower court had unilaterally granted bail to Kejriwal. Additional Solicitor General SV Raju, appearing for the DE, had argued before the High Court that the lower court’s order was one-sided and based on irrelevant facts. The lower court did not consider the fact. He said there can be no better case for canceling bail.

The ED in his SLP said that releasing Kejriwal at an important stage in the investigation would affect the investigation as Kejriwal holds an important post as the Chief Minister.
