A consumer court has ordered the railway CEO to pay over Rs 1.08 lakh to a passenger whose luggage was stolen during his journey. The commission cited the negligence and deficiencies in the services of Indian Railways.

The District Consumer Disputes Redressal Committee (Central District) heard a complaint that in January 2016, some unknown passengers stole a bag containing valuables worth Rs 80,000 from a passenger while they were traveling between Jhensi and Gwalior in January 2016. The passenger was traveling in the reserved car of Malwa Express.

The complaint states that it is the railway’s responsibility to provide a safe and comfortable journey as well as to protect passengers’ luggage. The committee chairman Indrajit Singh and official member Bansal said that it has the jurisdiction to hear the case. The complainant boarded the train from New Delhi and the journey continued till it reached Indore.

The commission said in an order passed on June 3 that apart from this, the General Management Office of Indian Railways is under the jurisdiction of the commission. The committee rejected the railway’s claim that the complainant was negligent and did not book for him.

The commission stated that the manner in which the incident happened and the valuables were stolen. After that, the complainant made efforts to submit a claim to the authorities for a proper investigation. But she had to face all kinds of inconvenience and harassment to exercise her legal rights.

The complainant was said to have filed a case of negligence and lack of service against the Indian Railways. During the trip, his luggage, which he kept in the bag on the reserved card, was stolen. If there was no negligence or lack of services on the part of a train or its employees, such an incident would not have happened.
