The Supreme Court on Thursday (September 26) rejected the Gujarat government’s plea in the Bilkis Bano case. In the application, the Gujarat government had demanded that the observations made by the Supreme Court in the order relating to the release of the culprits in this case be deleted.
The bench of Justice BV Nagarathna and Justice Ujjal Bhuiyan said, we are satisfied that there is no error in the record, there is no merit in the application filed to review the decision, therefore the order should be reconsidered. The applications are rejected.
On January 8, 2024, the Supreme Court had quashed the premature release of 11 people convicted of the rape of Bilkis Bano and the murder of her family during the 2002 Gujarat riots.
While giving the judgement, the bench of Justice Biwi Nagarathna and Justice Ujjal Bhuiyan said – Punishment is given to deter crime. We will also have to worry about the suffering of the victim. The Gujarat government has no right to take the decision to release. He has abused his power and authority. The bench had asked all the 11 convicted to surrender within 2 weeks.
In the Bilkis Bano case, the Gujarat government had released 11 convicts on August 15, 2022.
A petition was filed against Bilkis’ perpetrators on November 30. Two petitions were filed in the Supreme Court on 30 November 2022 against the release of Bilkis’ 11 convictions. In the first petition, challenging the release of 11 convictions, there was a demand to send them back to prison immediately. In the second petition, a request was made to consider the order given by the Supreme Court in May.
The court had said that the Gujarat government will take the decision on the release of the culprits. Bilkis said that when the trial of the case was being held in Maharashtra, how can the Gujarat government take the decision?
