Avonfield reference; Maryam Nawaz had no role in the purchase of properties, NAB prosecutor – Pakistan admits
During the hearing of the pleas in the Islamabad High Court regarding the Avenfield reference, the NAB prosecutor admitted that Maryam Nawaz had no role in purchasing the property.
A two-judge bench of the Islamabad High Court comprising Justice Amir Farooq and Justice Mohsin Akhtar Kayani heard the appeals of Maryam Nawaz and Capt (retd) Safdar against the Avenfield reference decision.
NAB Special Public Prosecutor Usman G. Rashid said in his arguments that the prime accused was not before the court nor was there any appeal, the role of Maryam Nawaz and Captain (R) Safdar was to help the prime accused.
On this occasion, the court observed that if Nawaz Sharif’s case is not pending, it does not mean that the charge has been properly proved.
Reference to the decisions of the Supreme Court in the Panama case
During the hearing, the NAB prosecutor referred to the Supreme Court judgments in the Panama case in which Justice Amir Farooq observed that the observations given by the Supreme Court are not in your favor, NAB had to independently prove all the charges. The Supreme Court decision has nothing to do with this appeal.
Justice Amir Farooq asked whether NAB had self-investigated after the JIT?
Justice Mohsin Akhtar noted that the Supreme Court’s observation was before the trial.
Maryam Nawaz is also accused of misleading the investigation
During the hearing, Justice Mohsin Akhtar Kayani asked that Maryam Nawaz was also accused of misleading the investigation, was the NAB or JIT investigator misled?
During NAB prosecutor’s arguments, Justice Amir Farooq observed that note that Wajid Zia is not the investigating officer but his witness.
During the hearing, Justice Amir Farooq observed that did Maryam Nawaz help in taking the property in 1993? Was Maryam Nawaz’s role in the seizure of the property in 1993? How did the 2006 Deed of Trust help build the property?
Justice Amir Farooq while talking to the NAB prosecutor remarked that you are moving in a closed lane.
The NAB prosecutor said in his arguments that the property was purchased by Nelson and Niscoll in the 1990s, Maryam Nawaz’s role was not in purchasing the property, Maryam Nawaz later helped keep the property secret.
During the hearing, Maryam Nawaz’s lawyer said that Nawaz Sharif has not said in any forum that the property belongs to him.
The NAB prosecutor said that Nawaz Sharif used to go to London and stayed in the same house, to which Justice Mohsin Akhtar noted that half of the people in Pakistan live in other people’s houses.
