Online retailer Amazon is challenging the certification of a union representing about 200 workers at a Montreal-area warehouse.

The American company claims that the process by which workers unionized was illegal because it involved workers signing union cards instead of voting by secret ballot.

Amazon’s lawyer, Frédéric Massa, told a labor court in Quebec today that the absence of a secret ballot violates the workers’ right to freedom of association.

Also, the company submitted a request to cancel the union’s certification completely.

Amazon’s requests have not yet been discussed in detail, and the discussion included whether the company had an interest in some of the matters it is bringing before the court.

For example, Amelie Belrose, a lawyer for the Quebec government, argued that it is the workers or their union, not the employer, who can argue whether workers’ rights have been violated.

Administrative Judge Iran Zaikoff took the case under advisement and said she would issue a decision as soon as possible.
